Privacy Policy

The Learning Project Elementary School (“School,” “we,” “our,” or “us”) collects and processes information that identifies you or can reasonably be linked to you, which we refer to in this privacy policy as “personal information.” This privacy policy describes how the School collects, uses, discloses, and otherwise processes personal information, and it applies to personal information we collect or process about prospective, existing, and former students (collectively, “students”), family members and other individuals associated with students, donors, alumni, and other members of the School community (collectively, “individuals,” “you” or “your”); provided that this policy does not apply to any individual in that person’s capacity as an employee, contractor, supplier, or other vendor of the School.

The School intends this privacy policy to comply with the various laws, rules, and regulations in the United States that govern the School’s processing of personal information, (collectively, “Data Privacy Laws”); provided that such Data Privacy Law apply only if and to the extent the School is subject to them and they govern personal information processed by the School.

Personal Information

The School processes personal information in the course of providing goods and services related to the following (collectively, “Services”): academic and other curricular and extra-curricular activities, education, training, and other development of students in kindergarten through sixth grade; physical, mental, and emotional health, counseling, student support, and other health and health-education related goods and services; business, management, and other operations of the School, including admissions, enrollment, financial assistance, curriculum, classroom management, student performance and education management, technology and technical support, collection and payment of tuition and other costs and fees, finance and accounting, communications with the School community and public, emergency management, facilities, and School campus access and management; communication, outreach, and School activities that involve family members of students, other individuals associated with students, and other members of the School community; solicitation, collection, and management of donations, gifts, and other monetary receipts; and other School activities.

In the course of providing these Services, the School processes a broad range of personal information. While it would be imprudent to attempt to list every type of personal information we process, the following lists some common categories, including personal information we have processed in the preceding 12 months.

  • Contact information, such as name, physical and mailing address, telephone number, email address, emergency contact details, and related identifiers.

  • Family and social information, such as details about family relationships, dynamics, guardianship, custody arrangements, authorized pickup designations, and other legal matters and social and community matters.

  • Educational and academic information, such as student performance and evaluations, student support plans, individualized academic needs and accommodations, involvement and participation in classroom and School activities, reading levels, academic conference notes, progress reports, assessments, and other education related information.

  • Therapeutic, counseling, and health information, such as school counseling records, neuropsychological evaluations, occupational therapy and speech-language pathology session notes, allergy and dietary information, medication needs, doctor and hospital contact information, immunization records, and medical emergency information.

  • Financial information, such as tuition and fee payment records, financial assistance application data, family income and tax information processed through the School’s financial assistance platform, and bank account information used for tuition billing.

  • Activities and Interests, such as information about personal interests and activities, both related and unrelated to School activities. 

  • Demographic Information, such as information about race, ethnicity, gender, age, disability status, and dietary preferences, when voluntarily provided or required for compliance or support purposes.

  • Admissions information, such as admissions applications, open house registration information, admissions interview records, and related correspondence and documentation.

  • Donor and development information, such as donor name, donation amount, giving history, alumni career and life updates, and other information related to contributions, gifts, or fundraising participation.

  • Media and images, such as photographs and video of students or community members used for identification, educational, or promotional purposes consistent with the School’s policies.

  • Usage and technological information, such as information about how you interact with the School’s website or technology platforms, including your IP address, device type, browser, and general patterns of use.

  • Business and operational information, such as information collected in connection with the School’s day-to-day business operations, including vendor and supplier contact and payment information, records generated in connection with finance and accounting functions, and other information collected in the ordinary course of managing the School’s facilities, technology systems, and administrative functions.

 

We collect personal information directly from you and from third-party sources, including when you submit an inquiry or interest form through the School’s website, register for an open house or school tour, apply for admission, complete enrollment or annual update forms, apply for financial assistance, make a donation or participate in fundraising activities, communicate with us, or otherwise interact with us.

Sensitive Personal Information

In addition to the categories listed above, the School necessarily processes personal information of a sensitive nature or is considered sensitive under applicable Data Privacy Laws, which includes but is not limited to the following: (i) personal information of children, including all enrolled students and, where applicable, siblings and family members who are minors, given that the School serves students in kindergarten through sixth grade; (ii) Social Security numbers and other government identification numbers; (iii) credit card, debit card, and bank and other financial account numbers; (iv) dates of birth; (v) race, ethnic origin, national origin, citizenship, immigration status, religious and political belief and affiliation, and sexual orientation and identity, where voluntarily provided or collected incidentally in connection with the School’s programs and activities; (vi) health and medical information including allergy, medication, counseling, neuropsychological, and therapeutic records; and (vii) family financial circumstances including income and tax information submitted through the School’s financial assistance platform. For purposes of this privacy policy, and unless otherwise specified or the context makes it clear, sensitive personal information is considered to be a category of personal information.

Purposes for Processing Personal Information

Due to the broad range of our Services, the School may process personal information for a broad range of purposes. While it would be imprudent to attempt to list every such purpose, the following lists some of the more common purposes for which we process personal information.

  • Provide services. Activities related to providing Services to or for you, including academic instruction, student support, counseling services, admissions, enrollment, financial assistance, tuition billing, advancement, emergency communications, and improving the Services we offer.

  • Communications and engagement. To communicate with you about School events, programs, advancement activities, alumni news, emergency notifications, and other School-related matters, and to respond to your inquiries.

  • Compliance, safety, and claims. To comply with applicable laws and regulations, protect our rights and interests, defend against claims, protect an interest that is essential for the life or physical safety of a student or another person, detect and respond to security incidents, and monitor, develop, maintain, and protect the operation, security, and integrity of our website and technology systems.

  • Alumni affairs and advancement. Activities related to alumni relations, communications, donor development, School promotions, institutional advancement, and other engagements with graduates, alumni families, and donors, consistent with their relationship and reasonable expectations. 

  • Research and institutional development. For purposes of evaluating programs, improving curriculum and student services, and engaging in other forms of institutional review and development.

  • Business relationships. To interact with individuals and third parties with respect to the School's or their business activities and interests, including vendors, service providers, outside specialists, contractors, insurers, legal counsel, and other parties with whom the School engages in the ordinary course of its operations. 

  • Operations. To conduct our internal operations, including administration, legal, compliance, technology, and vendor management, and to engage in other activities that are reasonably aligned with the expectations of individuals, reasonably anticipated based on your relationship with the School, or otherwise compatible with the processing of personal information in furtherance of providing the services.

Legal Bases for Processing Personal Information

The School processes personal information on the following legal bases.

  • Consent and direction. Based on your consent, direction, or other permission you provide to us, including parental or guardian consent for the processing of personal information.

  • Legal obligation. To comply with applicable laws and regulations, including Data Privacy Laws, and other legal obligations imposed on the School.

  • Vital interests. To protect an interest that is essential for the life or physical safety of a student or another person, including in emergency and crisis situations.

  • Legitimate interests. Where processing is necessary for our legitimate interests or the legitimate interests of a third party, such as maintaining the security of our technology systems, preventing fraud, resolving disputes, and operating and improving the Services, and where those interests are not overridden by your rights and freedoms.

  • Performance of a contract or agreement. To perform our obligations under enrollment agreements, financial assistance agreements, donor agreements, and other agreements with you or in connection with which personal information is processed.

Disclosure of Personal Information

The School may disclose personal information under the following circumstances.

  • Consent and direction. To third parties you direct us to share your personal information with, or where you have otherwise provided consent or permission for us to make such a disclosure.

  • Provide Services. As necessary to provide the Services and conduct our operations, including to third-party technology platforms and service providers that assist us with admissions, enrollment, tuition billing, financial assistance, payroll and human resources, donor management, student learning and assessment, emergency communications, scheduling, and other School functions, each of which is engaged pursuant to appropriate contractual arrangements addressing the protection of personal information.

  • Agents of the School and individuals. To directors, officers, employees, contractors, agents, representatives, insurers, and attorneys of the School or of individuals, as necessary or appropriate to provide Services or support our operations, where such disclosure is not otherwise covered by the purposes described in this privacy policy.

  • Outside specialists. To outside specialists who provide services to students on or in connection with School premises, including occupational therapists, speech-language pathologists, and other providers, subject to appropriate consent and confidentiality arrangements.

  • Compliance, safety, and legal process. To comply with applicable laws and regulations, protect our rights and interests, defend against claims, and respond to valid legal process or lawful requests from governmental, regulatory, or law enforcement authorities, including child safety and public health agencies. Information shared for this purpose is limited to names and contact information, or such other information that the School may disclose with appropriate consent or in line with reasonable expectations.

  • School community directory and parent communication. To other parents, guardians, and members of the School community, for purposes of facilitating school-related communication and activities through the School’s parent portal and directory.

  • Business transfers. In anticipation of or in connection with an acquisition, merger, consolidation, restructuring, or other similar organizational change.

Photo and Video Consent

The School collects photo and video consent from families annually through the enrollment form. Families select their permission level and the School maintains a do-not-publish list of students whose images may not be used in School publications, social media, or other external communications. All proposed uses of student images are reviewed through the School’s internal approval process before publication. The School does not publish the names of current students in connection with their images in any external communications without separate consent.

Communications

From time to time, the School may use some of your personal information to communicate with you about School events, programs, advancement and fundraising activities, alumni news, and other School-related matters through channels including email, the School’s website, and social media. You may opt out of receiving non-essential School communications at any time by following the unsubscribe instructions included in the relevant communication or by contacting our privacy officer. Opting out of advancement or community communications will not affect your receipt of essential School communications such as enrollment notices, tuition billing, emergency notifications, and other operational communications.

Use of Artificial Intelligence

The School may use artificial intelligence (AI) tools for purposes related to the Services, including for the purposes and bases described above. While it would be imprudent to attempt to list every use of AI, particularly since it is an evolving technology, the following describes some of the ways the School currently uses or may use AI: prepare lesson plans, educational materials, worksheets, and other academic content; organize, summarize, and analyze non-student information; create documents, text, and communications based on non-sensitive information and prompts; conduct research; use note-takers and transcribers for internal meetings and student support team meetings; and perform other discrete aspects of the Services. 

 

Video and Audio Recording

The School uses technology to facilitate meetings, video conferences, and other School events, including technology that may capture video and audio. By participating in School meetings, video conferences, and events where recording is in use, you consent to the School’s recording and processing of video and audio collected during such meetings and events.

Privacy Rights

Depending on the personal information the School processes about you and the manner in which we process it, you may have the following rights with respect to our processing of your personal information, and parents and legal guardians of students may have the following privacy rights related to our processing personal information of students.

  • Scope of processing. Disclosure about how we process personal information, the categories of personal information we process, and the categories of sources from which such personal information was obtained.

  • Access. Access or receipt of a copy of personal information, including, if appropriate, in a portable, machine-readable, and commonly used format.

  • Correction. Rectify or correct inaccurate or incomplete personal information.

  • Deletion. Deletion or erasure of personal information, subject to applicable legal retention requirements.

  • Objection. Object to our processing of personal information in certain circumstances.

  • Withdraw consent. Withdraw consent if we rely on consent as the legal basis for processing personal information, provided that such withdrawal will not affect the lawfulness of processing that occurred before withdrawal. 

  • Automated decision making. Not be subject, in certain circumstances, to a decision based solely on automated processing, including profiling, that produces legal effects or similarly significantly affects you.

  • Selling, profiling, and targeted advertising. Disclosure about whether the School sells, shares, trades, exchanges, or brokers personal information with or to a third party for the purpose of that or any other third party using the personal information to market on their own behalf, which is referred to as “selling”; disclosure about whether the School uses automated decision making to evaluate, analyze or predict personal aspects related to an individual’s economic situation, health, personal preferences, interests, reliability, behavior, location, or movements, which is referred to as “profiling.”; disclosure about whether the School targets advertising to individuals based on their activities on unaffiliated third party websites, which is referred to as “targeted advertising”; and to object or opt-out of such selling, profiling and targeted advertising.

To make a request concerning these rights, please complete and submit the Privacy Rights Request Form on our website. The School will respond to all complete requests within 45 days, subject to extension of that period. Also, there may be a delay in processing a request while we verify that the request is valid and originates from a person authorized to make it.

There may be valid reasons that require or permit us to decline to honor a request, in whole or in part, including legal and regulatory requirements that we retain and process certain information. Also, honoring certain requests may limit or prevent us from providing Services to the individual about whom the request is made. In those situations, we will notify you in writing within 45 days, subject to extension of that period. You may also contact one of our privacy officers for information about and help with those situations.

The School will not discriminate against an individual for exercising these rights or any other rights under Data Privacy Laws, including by not denying Services to that individual, not providing a different level or quality of Services to that individual, and not suggesting that individual will receive a different level or quality of Services.

Selling, Profiling, and Targeted Advertising

The School does not engage in selling, profiling, or targeted advertising of personal information, except with respect to tracking technologies as discussed below.

Security

We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. Personal information is protected using appropriate physical, technical, and organizational measures.

Data Retention

The School retains personal information for as long as necessary to fulfill the purposes for which it was collected, to comply with applicable legal obligations, and to resolve disputes.

Website, Cookies, and Tracking Technologies

The School may collect and generate information about you when you interact with our website, which may include name and contact information (as described above), information about the device you use to interact with our website, and information about your interaction with our website (such as content you view, features you access, sites you view immediately before and after you access our website, content you view on our website, search terms you use on our website, and content in which you have indicated interest).

When you visit the School’s website, we may place a cookie (a text file containing a randomly assigned number) or a similar technology on your device so we have the ability to customize the look and feel of the website for you. Cookies remember information about you, your preferences, and your device for a better user experience when visiting the website. Using cookies, we may also collect other information about your use of the website, including your IP address, username, session identification, browser, web pages you view and referring web pages, when you access the website, and general online behavior for performance and marketing purposes.

The School may use third-party analytics tracking technologies and tools to collect information about how you use our website, such as the frequency of visits, pages viewed, traffic data, location, referring and exit pages, and error information. These tools may also collect device-specific data, including your IP address, operating system, browser type, and Internet connection details. These tools examine website activities to prepare usage reports, and this information helps us improve our website and enhance user experience. Tracking information will be shared with the third-party analytics provider, which may use that information for its own purposes, potentially including marketing or advertising. While the tracking information we collect through such tools is not sufficient on its own for the School to identify you, the third-party analytics provider may be able to combine it with other data it has to identify you.

If you would like to limit the ability of cookies or tracking technologies and tools to track your activity on our website, you can either configure your preferences for cookie settings on our website, or disable cookies in your Internet browser settings, although doing so may impact the performance and effectiveness of our website or other websites.

Automated Decision Making

The School does not use automated decision making or profiling in the processing of personal information, and does not make decisions that affect you based solely on automated decision making or profiling using personal information.

Changes to This Policy

The School reserves the right to change or amend this privacy policy at any time and for any reason, including to remain in compliance with Data Privacy Laws. We will notify you of material changes through the School’s standard communication channels. Your continued engagement with the School after the effective date of any updated policy constitutes your acceptance of the changes.
